FORT WORTH, Texas — A routine decision by a mother to make an unannounced visit to her son’s daycare has led to a lawsuit and allegations of a disturbing incident inside the facility.
The family of a 4-year-old boy is suing Arka Montessori Academy of Risinger after surveillance footage allegedly captured an adult employee becoming involved in an altercation involving the child.
The lawsuit stems from an April 27 visit by the boy’s mother, Heather Harris. According to the family, she had an uneasy feeling about her son and decided she needed to find out what was happening.
Her concerns reportedly grew after seeing her son’s demeanor.
“I knew from his cry, in the look on his face, that something had happened. And from that point on, I said, I need to see the cameras,” Heather Harris told WFAA.
What the family allegedly found on surveillance footage became the basis of a lawsuit against the daycare.
Attorney Calls Alleged Incident a ‘Child Fight Club’
According to the family’s attorney, Russell T. Button, surveillance footage allegedly shows a staff member, described as a former employee, encouraging her own son to attack the 4-year-old.
Button also alleges the employee shook the child and caused him to fall. The attorney described what he said the family saw in extremely stark terms.
“This place looked like a child fight club,” Button told. “It felt like one. This kid was thrown around like a human rag doll by somebody that was supposed to protect him.”
The allegations have raised questions about how the child was treated while in the care of the facility and whether appropriate safeguards were in place to protect him.
The lawsuit argues that the daycare failed in its duty to protect the child. The allegations remain claims made in the lawsuit, and the filing does not by itself establish liability.
Parents Say They Trusted the Daycare
Before enrolling their son, Heather and Richard Harris said they had carefully researched daycare options.
The couple said they were looking for a facility that was clean, educational and equipped with 24-7 surveillance cameras. They believed Arka Montessori Academy met those expectations.
“Education was big; it was clean,” Richard Harris told. “Arka, we thought we hit gold with Arka.”
That confidence changed after the alleged incident.
“The trust that I put in this daycare, they failed us,” Richard Harris said.
Heather Harris similarly reflected on the difference between what the facility appeared to offer and what her family says happened behind its doors.
“Everything that glitters isn’t gold, and that facility was one of them,” she said.
For the family, access to surveillance footage became particularly important because Heather said her initial concern came from her son’s behavior and emotional response.
State Records Show Previous Deficiencies
The lawsuit comes as state records show the academy had accumulated 21 deficiencies since January 2024.
According to the information provided, those deficiencies involved health and safety risks. However, a subsequent inspection conducted on August 20, 2026, recorded zero deficiencies.
The inspection result provides an important piece of context as the legal case moves forward, although it does not resolve the allegations surrounding the April incident.

The family’s attorney said bringing the allegations to light could also have a broader impact on childcare facilities.
“When you speak up, when you bring these things to light, it helps hold everyone accountable, and that makes other daycares take notice,” Button said.
He added that accountability could encourage facilities to improve safety for children whose parents depend on daycare while working.
Family Says Child Is Moving Forward
Despite the disturbing allegations, Richard Harris said his son continues to show his personality and interests.
Before the incident, the boy reportedly enjoyed sports and practicing Michael Jackson dance moves. Now, his father says, the child is still finding ways to express himself.
“He’s walking around now with his Michael Jackson glove,” Richard Harris told. “So, he’s just pretty awesome.”
The lawsuit will now move through the legal process as the allegations are addressed. For the Harris family, the case is about more than what they say happened to their own child. They hope speaking publicly will encourage greater accountability and help other parents feel confident that their children are safe while in daycare.
